We would like to clarify the confusion that exists between this concept and legal translation. Although sworn translation deals with all types of texts (official documents, academic records, minutes, etc.) which, although not necessarily of a legal nature may have legal repercussions, legal translation is limited exclusively to legal texts. This does not mean to say, of course, that legal translations cannot also be sworn translations and, indeed, they usually are, particularly when they are involved in legal proceedings.
The next thing we should take into account is that, unlike other forms of translation, legal translation has a very specific function, which consists simply of protecting the rights of citizens in a world where, in many cases, borders have become obsolete. Therefore, apart from the ethical considerations, this entails a number of implications for translators.
The first of these is that legal translation goes beyond the scope of language itself, something we have already taken into account when referring to other forms of translation. In other words, it is not enough just to transpose one word for another. If we did this, we would cause tremendous confusion and ambiguity which would adversely affect our clients, and would find ourselves in the hands of the so-called «false friends» that often hamper this type of translation. For example, the English word, «jurisprudence», is not the same as jurisprudencia in Spanish. Moreover, style, typographic conventions, the formulas used, all these peculiar aspects of legal texts, vary from one culture to another, where legal traditions are not necessarily the same. Therefore, in many cases, translation is not possible without certain cultural compensations. Thus, expert knowledge of the legal system of the source and target culture is required in order for the resulting text to be acceptable.
